Xsolla (USA), Inc. (‘Xsolla USA’), together with Skrill USA, Inc. (“Skrill USA”), (collectively referred to as “we”, “us” and “our”) provide you with a stored value account (“Xsolla Money Account”) which is issued by Skrill USA. The Xsolla Money Account is registered to you, enables you to send and receive electronic payments and is linked to your existing gaming account with Xsolla USA. Your personal data is processed and shared between Xsolla USA and Skrill USA whenever necessary to make this work and provide the service you signed up to receive. To do this, we act as “Joint Controllers” under privacy laws for the collection of account creation and verification data and for customer services. We are required to take all necessary steps to inform you about how we use, share and protect the information we collect about you, and how you can exercise your rights under privacy laws. Xsolla USA owns and operates the mobile application and website you interact with to create your Xsolla Money Account. It also provides a customer support service and ensures that all marketing activities, the use of trackers and similar technologies comply with and respects your privacy and your choices. Skrill USA provides you with a stored value account and enables you to make transactions in accordance with the Xsolla Money Account Terms of Use.

Skrill USA provides the functions for your Xsolla Money Account that enable you to add and withdraw funds from your Xsolla Money Account in accordance with the Xsolla Money Account Terms of Use. Skrill USA provides this service to customers in the USA as a licensed money transmitter under the laws of various U.S. states and pursuant to its registration with FinCEN. Skrill USA receives your data from Xsolla USA to provide its electronic money services but does not have access to any specific data about your wider gaming account that you have with Xsolla USA.

Xsolla USA ensures the access to your Xsolla Money Account information, and we exchange data mutually to ensure you can see your transactions carried out using our systems in your Xsolla Money Account.

Skrill USA and Xsolla USA share information to meet our own regulatory obligations to protect our customers and financial systems by managing risk and preventing and detecting fraud, and other financial crimes. This includes exchanging information about your Xsolla Money Account creation, verification (“know-your-customer” checks) and transactions, including transactions through other payment service providers which are used to pay to or withdraw from your Xsolla Money Account. Please be aware that the verification services do use biometric data with your consent to verify you: this happens when you are asked to take a selfie and upload your government issued photo ID. The data you provide to Xsolla USA will be shared with Skrill USA wherever necessary to make sure we meet our obligations, work with all relevant regulatory bodies, and provide you with the service you expect.

You have the rights to know how we are using your data, to have errors corrected and to challenge how we are using your data and for how long we hold it.

To keep this simple when using the Xsolla Money Account, Xsolla USA will handle all of your queries and privacy rights requests and ensure Skrill USA is engaged whenever necessary.
